2. Nature of Business

Birchwyn operates on a print-on-demand (POD) / dropshipping model from India. This means:

  • Birchwyn does not manufacture, hold inventory of, warehouse, or personally package any products sold through this Site.
  • Every product is produced only after a customer places an order — nothing is pre-made or kept in stock.
  • Birchwyn is the seller of record for all transactions made through this Site and is fully responsible for order accuracy and customer service, even though physical production and shipping are carried out by a third-party manufacturing and fulfillment partner.

3. Manufacturing and Fulfillment Disclosure

All products sold on Birchwyn are manufactured, printed, packaged, and shipped by our third-party production and fulfillment partner, through a global network of independent print providers.

Please note the following regarding this arrangement:

  • Once an order is confirmed and payment is processed, the order is automatically transmitted to our fulfillment partner for production.
  • The order is assigned to an appropriate print provider based on the product ordered and the delivery destination.
  • The assigned print provider manufactures, packages, and ships the item directly to the customer.
  • Because production is distributed across an independent network of print providers, minor variations in print placement, color, or material may occur between orders.
  • Birchwyn remains responsible for the overall customer experience, order accuracy, and resolution of any issues raised by customers.

Customers are requested to direct all order-related concerns to Birchwyn directly at birchwynstore@gmail.com, rather than to our production partners, so that Birchwyn can investigate and resolve the matter appropriately.

4. EU / UK Responsible Person — General Product Safety Regulation (GPSR)

In accordance with EU Regulation 2023/988 (the General Product Safety Regulation) and equivalent UK requirements, the following Responsible Person has been designated to hold product safety and compliance documentation on behalf of our fulfillment partner for products shipped to customers in the European Union and United Kingdom:

Please note that the Responsible Person listed above acts solely as the designated product safety contact required under GPSR for products manufactured and fulfilled by our production partner. This entity is not the seller of the products, is not affiliated with Birchwyn as a business, and does not handle customer orders, payments, returns, or refunds. All commercial matters relating to your purchase — including order status, returns, and refunds — must be directed to Birchwyn at birchwynstore@gmail.com.

5. Data Sharing Disclosure

To fulfill your order, certain personal information you provide at checkout — including your name, shipping address, and order details — is shared with our fulfillment partner and its print providers solely for the purpose of producing and delivering your order. This data sharing is limited strictly to what is necessary for order fulfillment.

6. Products and Quality

All products are custom-manufactured to order. As such:

  • Once an order enters production, it cannot be modified or canceled, as noted in our Refund Policy and Terms of Service.
  • Slight variations in color, print alignment, or material may occur due to the nature of on-demand, distributed manufacturing.
  • Should a product arrive damaged, defective, or materially different from what was ordered, customers may raise the issue with Birchwyn in accordance with our Return and Refund Policy.

7. Shipping and Delivery

Orders are shipped directly from the assigned print provider's production facility to the customer's delivery address. As Birchwyn operates from India while fulfillment occurs through a global network of production facilities, delivery timeframes may vary depending on the customer's location, product type, and shipping carrier. Please refer to our Shipping Policy for estimated timeframes.

Birchwyn is not liable for delays caused by production scheduling, customs processing, or third-party shipping carriers beyond our reasonable control.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Birchwyn shall not be held liable for any indirect, incidental, or consequential loss or damage arising from delays, defects, or issues caused by our manufacturing and fulfillment partner, except as otherwise provided under applicable consumer protection law. This does not affect any statutory rights you may have as a consumer under the laws of your country of residence.
